1. Acceptance of Terms

By accessing or using SwamiSeva (the “Platform”), you agree to be bound by these Terms & Conditions and our Privacy Policy, which are incorporated herein by reference. If you do not agree with any part of these terms, please do not use the Platform. We reserve the right to update these terms at any time; continued use of the Platform constitutes acceptance of the revised terms.

2. About Us

SwamiSeva is operated by PSGL Technology Solutions Private Limited, a company incorporated under the Companies Act, 2013, with its principal place of business in Bengaluru, Karnataka, India. We provide an online platform that connects devotees with qualified Vedic priests for the performance of sevas, homams, and pujas.

3. Account Registration & Security

To access certain features of the Platform, you may be required to create an account. By registering, you agree to:

Provide accurate, complete, and current information during registration and keep it up to date.
Keep your login credentials confidential and not share them with any third party.
Notify us immediately at support@swamiseva.com if you suspect any unauthorised access to or use of your account.
Be at least 18 years of age to create an account. By registering, you represent that you meet this age requirement.

We reserve the right to suspend or terminate your account if we determine, at our sole discretion, that you have violated these Terms, provided false information, or engaged in fraudulent or abusive conduct.

4. Services

SwamiSeva facilitates bookings between devotees and independent Vedic priest service providers. We are not a temple or a religious institution. The priests listed on our Platform are independent practitioners, and we act solely as an intermediary platform. We strive to ensure quality, authenticity, and adherence to Vedic tradition, but the actual performance of the seva is the responsibility of the respective priest. We do not guarantee a specific outcome or blessing from any ritual performed.

We reserve the right to modify, suspend, or discontinue any seva offering at any time without prior notice, including in cases where a priest becomes unavailable. In such cases, we will make reasonable efforts to offer an alternative or refund.

Occasion Pooja Booking. The Platform also allows you to book a pooja performed on behalf of one or more honorees for a personal occasion, such as a birthday, wedding anniversary, or death anniversary, at a temple of your choice. You select the occasion, temple, deity, and pooja, and provide honoree details so the pooja can be performed correctly. You may optionally add prasad for delivery to an address you provide. As with other sevas, the actual performance of the pooja is the responsibility of the respective temple or priest, and we act solely as an intermediary platform.

Free First Pooja. The Archana pooja fee for your first occasion pooja booking is offered free of charge, for any occasion (any optional add-ons, such as annadhan, remain payable). This offer is limited to one free pooja per registered user, and may be modified or withdrawn by us at any time without prior notice.

Referral & Giveaway Program. The Platform may offer a referral link tied to your account. When a friend or family member creates an account through your link, you earn one entry into a periodic giveaway draw for a sacred idol or similar item, subject to any eligibility rules we publish at the time. Entries are granted only for a distinct, genuine new registered account, never your own; there is no cash alternative and no purchase of an entry is possible or required. We may modify, suspend, or discontinue the program, its eligibility rules, or its prizes at any time without prior notice. Winners, where announced, are notified and announced through our official channels (including our social media accounts). Where a prize idol's quality claims (such as warranty, plating, or purity) are stated on the Platform, those claims are made by the prize's supplier and not independently verified or warranted by us.

AI Spiritual Guide. The Platform may offer an AI-powered Spiritual Guide that provides general, rashi-based spiritual guidance, answers questions about the Platform, and suggests relevant sevas. This guidance is for informational and devotional purposes only. It is generated by an automated system, may be inaccurate or incomplete, and does not constitute professional medical, legal, financial, or psychological advice, nor a guarantee of any outcome. You should not rely on it as a substitute for advice from a qualified professional. Your use of the AI Spiritual Guide is subject to usage limits that we may set or change at our discretion.

5. Booking & Payment

All bookings are subject to availability and are confirmed only upon receipt of full payment.
Payments are processed in Indian Rupees (INR) through Razorpay, a PCI-DSS compliant payment gateway. By making a payment, you also agree to Razorpay’s Terms of Use.
A booking confirmation will be sent to the email address or mobile number provided at the time of checkout.
Pricing displayed on the Platform is inclusive of all applicable taxes unless otherwise stated.
You are responsible for providing accurate devotee details (name, gotra, nakshatra, rashi, and date of birth) at the time of booking. We are not responsible for errors in ritual performance caused by inaccurate information provided by you.

6. Cancellation & Refund Policy

Self-service cancellation: You can cancel an eligible booking yourself from the My Bookings section of your account, while the booking is still pending or confirmed and its seva or occasion date has not yet passed. Any refund you are due under this policy is issued automatically and immediately to your original payment method, with no need to contact us first.
Full refund: Cancellations made at least 48 hours before the scheduled seva date are eligible for a full refund, issued automatically to the original payment method and typically settled within 5 to 7 business days by your bank or card provider.
No refund: Cancellations made less than 48 hours before the scheduled seva, or after the seva has commenced, are not eligible for a refund. The booking is still cancelled and the reserved date released.
Priest unavailability: If we are unable to provide the booked seva due to priest unavailability or a Platform issue, you will receive a full refund, typically settled within 5 to 7 business days.
Life Occasion Poojas: Bookings made through Life Occasions (birthday, anniversary, remembrance, and milestone poojas) are eligible for a full refund if cancelled any time up to the day before the scheduled event date, issued automatically on cancellation.
Free bookings: A booking made free of charge (such as the free first pooja) involves no payment, so there is nothing to refund and it is non-refundable. Cancelling a free booking simply releases the reserved date.
If you are unable to cancel online (for example, the date has already passed or you need help with an edge case), write to us at support@swamiseva.com with your booking reference number and we will assist.

7. User Responsibilities

By using SwamiSeva, you agree to:

Provide accurate, complete, and up-to-date information during booking, including devotee details such as name, gotra, nakshatra, rashi, and date of birth where requested.
Use the Platform only for lawful purposes and in compliance with all applicable Indian laws and regulations.
Not misuse or attempt to disrupt the Platform, its servers, or associated networks.
Not impersonate any person or entity or misrepresent your affiliation with any person or entity.
Treat priests and Platform staff with respect. Abusive or threatening behaviour will result in immediate account suspension.

8. Prohibited Uses

You agree not to:

Use the Platform for any unlawful purpose or in violation of applicable Indian law, including the Information Technology Act, 2000.
Attempt to gain unauthorised access to any part of the Platform, its servers, databases, or related systems.
Upload, transmit, or distribute any content that is defamatory, obscene, threatening, hateful, or that infringes any third-party intellectual property or privacy rights.
Use automated tools (bots, scrapers, crawlers, or similar technologies) to access or extract data from the Platform without our prior written consent.
Use the Platform to send unsolicited commercial communications (spam) to other users or third parties.
Engage in any conduct that could damage, disable, overburden, or impair the Platform or its infrastructure.
Reproduce, duplicate, copy, sell, or exploit any portion of the Platform for commercial purposes without our express written consent.
Create multiple accounts, or otherwise misrepresent your identity, to claim a promotional offer more than once, including the free first pooja, which is limited to one per registered user.

Violations may result in immediate account suspension, permanent ban, and legal action under applicable Indian law.

9. Intellectual Property

All content on the Platform (including text, graphics, logos, images, audio-visual content, and software) is the property of PSGL Technology Solutions Private Limited or its content suppliers and is protected under applicable Indian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content without our prior written consent.

10. Third-Party Services

The Platform integrates with third-party services that are governed by their own terms and policies:

Razorpay: Payment processing. By completing a payment, you also agree to Razorpay’s Terms of Use and Privacy Policy.
Google (Gemini AI): Our AI Spiritual Guide is powered by Google’s Gemini AI service, which processes your guide conversations to generate responses. Its use is governed by Google’s Terms of Service.
Microsoft (Clarity): We use Microsoft Clarity for website analytics, heatmaps, and session recordings to help us understand and improve the Platform. Its use is governed by Microsoft’s Privacy Statement.
Google (Google Ads): We use the Google Ads conversion tag to measure completed bookings and attribute them to advertising campaigns. Its use is governed by Google’s Terms of Service.
Google (Google Analytics): We use Google Analytics 4 to measure how visitors use the Platform so we can improve it. Its use is governed by Google’s Terms of Service.
Live-stream platforms: Seva performances may be streamed via YouTube or other third-party video platforms. Your use of those platforms is governed by their respective terms.
Communication providers: SMS and WhatsApp notifications are sent via third-party messaging services.

SwamiSeva is not responsible for the availability, security, accuracy, or terms of any third-party service. Links to third-party sites from our Platform do not constitute an endorsement.

11. Disclaimer of Warranties

The Platform and its services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. PSGL Technology Solutions Private Limited does not warrant that:

The Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
A specific priest will be available for any particular date or time slot.
The results of using the Platform will meet your expectations or confer any specific spiritual outcome.
Any errors or defects in the Platform will be corrected within any particular time frame.

Nothing in these Terms shall exclude liability that cannot be lawfully excluded under applicable Indian law.

12. Limitation of Liability

To the fullest extent permitted by applicable law, PSGL Technology Solutions Private Limited, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including but not limited to loss of profits, loss of data, loss of goodwill, or service interruption) arising from your use of, or inability to use, the Platform or its services, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you in connection with any claim arising from your use of the Platform shall not exceed the amount paid by you for the specific booking giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless PSGL Technology Solutions Private Limited and its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

Your use of or access to the Platform.
Your violation of these Terms & Conditions.
Your violation of any rights of a third party.
Any content, information, or materials you submit, upload, or transmit through the Platform.

14. Force Majeure

PSGL Technology Solutions Private Limited shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, floods, earthquakes, pandemics, epidemic outbreaks, government orders or regulations, power outages, internet or telecommunications service disruptions, labour disputes, or civil unrest.

In such events, we will notify you as soon as reasonably practicable and will make reasonable efforts to reschedule the affected seva or issue a refund, as appropriate.

15. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law principles. Any dispute, claim, or controversy arising out of or in connection with these Terms, or the breach, termination, or validity thereof, shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India. You hereby consent to the personal jurisdiction of such courts and waive any objection based on inconvenient forum.

16. Severability & General

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. All remaining provisions will continue in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and PSGL Technology Solutions Private Limited regarding your use of the Platform, and supersede all prior or contemporaneous communications, agreements, or understandings.
Waiver: Our failure to enforce any right or provision of these Terms on any occasion shall not be construed as a waiver of such right or provision on any future occasion.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor entity without restriction.
Notices: Any notices or communications under these Terms shall be made by email to support@swamiseva.com (to us) or to the email address registered on your account (to you).
